Terms of Use for Steppa

These Terms of Use ("Terms") govern your access to and use of the Steppa mobile application (the "App") and related services we may provide. By downloading, installing, or using the App, you agree to these Terms.
If you do not agree, do not use the App.
Our Privacy Policy explains how we handle information. By using the App, you also acknowledge that policy.
1. Who we are; eligibility
The App is offered by SMRLND LLC ("we," "us," "our").
The App is intended for users 13 years of age or older. By using the App, you represent that you meet this requirement.
2. What the App does (summary)
Steppa is a step-counting and social fitness app. It uses step data from Apple Health and your device's motion sensors to track your daily activity, then ranks you against other Steppa users in global leaderboards, tiered leagues (e.g., Bronze, Silver, Gold), and groups you join or create. The App also tracks personal step records, unlocks achievements, and surfaces celebrations when you reach milestones.
Features, labels, and behavior may change as we improve the App. We do not guarantee uninterrupted or error-free operation.
3. Your account
To use the App, you must create a Steppa account using a valid email address and password. As part of account creation you will choose a username, which is shown to other Steppa users in leaderboards, league standings, group memberships, and group activity. We may require you to verify your email address before some features are available.
You may optionally upload a profile photo or use a generated colored avatar. You can change your username or profile photo, opt your step counts in or out of public ranking, and delete your account at any time from Profile → Settings → Advanced → Delete Account.
You are responsible for safeguarding your password and for any activity under your account. Notify us promptly if you believe your account has been compromised.
Account creation and authentication are powered by Firebase Authentication (a Google service); account, profile, and step data are stored in Cloud Firestore and Firebase Storage. See the Privacy Policy for details about what we store and why.
4. Apple device requirements; third-party permissions
The App runs on compatible Apple devices and may require Apple services and permissions, including but not limited to:
- HealthKit (read-only step data we request),
- Motion & Fitness (device pedometer / motion activity),
- Notifications (including local notifications and push notifications for celebrations, league results, and group activity).
You are responsible for granting or revoking permissions in Settings. If you revoke permissions, features that depend on them may stop working or be limited.
You understand that Apple Health, motion sensing, and related features are provided by Apple under Apple's terms and system behavior. We do not control iOS or the accuracy of Apple's underlying step measurement.
5. Subscriptions and auto-renewal (Steppa Pro)
Certain features require an active paid subscription (branded in-product as Steppa Pro). At present, Steppa Pro unlocks the ability to create private groups (groups whose membership is invite-only and whose leaderboards are visible only to members). The set of Steppa Pro features may change as the App evolves.
Subscription offerings may include weekly, monthly, and yearly plans, as shown in the App at purchase time.
5.1 Payment through Apple
Paid subscriptions are billed by Apple via your Apple ID using In-App Purchase. Apple's terms and the paid application terms in the App Store apply to those transactions. We do not directly process your payment card for In-App Purchases.
5.2 Auto-renewal
Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Renewal is charged to your Apple ID at the then-current price for your plan (subject to Apple's pricing display and any applicable taxes).
5.3 Free trials and introductory pricing
If we offer a free trial or introductory price, the App Store and Apple will show the duration, renewal price, and cancellation terms at purchase. When a trial ends, Apple may charge you for the next subscription period unless you cancel before the trial ends. You are responsible for reviewing those terms before you confirm purchase.
(As of these Terms, product configuration may include trials on select plans; always rely on what Apple displays at checkout.)
5.4 Managing and canceling subscriptions
To manage or cancel a subscription:
- Open Settings on your iPhone → tap your name → Subscriptions, or
- Use the App Store app → your account → Subscriptions, or
- In the App, tap Profile → Settings → Manage Subscription, which deep-links to the iOS Subscriptions screen.
Cancellation stops future renewals; it does not refund the current period unless Apple's policies say otherwise. Deleting the App does not automatically cancel your subscription, and deleting your Steppa account does not cancel an Apple-billed subscription either — you must cancel through Apple as described above.
5.5 Tier changes (upgrade and downgrade)
You can view all current plans and switch tiers at any time from Profile → Settings → View Subscription Plans. Upgrades typically take effect immediately with proration; downgrades typically take effect at the next renewal. Tier-change behavior, proration, and confirmation messaging are controlled by Apple's StoreKit, not by us.
5.6 Price changes
Apple or we may change subscription prices in accordance with App Store rules. Apple typically notifies you before renewal at a new price and may require you to re-consent. If you do not agree to a new price, cancel before the change takes effect as Apple instructs.
5.7 Restore purchases
If you reinstall the App or use a new device signed into the same Apple ID, use Restore Purchases in Profile → Settings → Steppa Pro → Restore purchases (or equivalent in Apple's subscription settings). Restore is subject to Apple's systems and your purchase history.
5.8 Refunds and billing disputes
Refund requests and billing disputes for In-App Purchases are handled by Apple under Apple's refund policies, not by us directly. If Apple grants or denies a refund, that decision is between you and Apple.
6. License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, as permitted by the App Store usage rules.
You may not:
- copy, modify, or create derivative works of the App except as allowed by law;
- reverse engineer, decompile, or attempt to extract source code except where prohibited law allows;
- rent, lease, sell, sublicense, or commercially exploit the App;
- use the App to violate law or third-party rights;
- interfere with or disrupt the App, servers, or networks.
All rights not expressly granted are reserved.
7. Acceptable use
You agree not to misuse the App. Misuse includes, without limitation:
- Fabricating step counts or otherwise attempting to inflate your activity through means other than genuine human movement (for example, shaking the device, attaching it to a pet or vehicle, or using automated tooling) to gain a ranking advantage;
- Creating accounts, usernames, avatars, group names, group descriptions, or other content that is abusive, harassing, deceptive, sexually explicit, hateful, or unlawful, or that impersonates another person or brand;
- Harassing, threatening, or bullying other Steppa users through group activity, naming, invitations, or any other in-app mechanism;
- Using the App to collect or scrape data about other users beyond what the App's normal social features display;
- Circumventing technical limits, abusing Apple permissions, or using the App in a way that harms others or violates applicable law.
We may suspend or terminate your access, reset your username, remove user-generated content, or remove you from groups if we reasonably believe you have violated these Terms.
8. Health, fitness, and wellness disclaimer
The App is not medical advice and is not a medical device. It is intended for wellness and motivation purposes only. Always consult a qualified health professional for medical questions.
Step counts and activity data may be inaccurate or incomplete due to device limitations, permission state, sync delays, time-zone handling, or other factors. We do not guarantee specific health outcomes and we do not guarantee the precision of any leaderboard ranking, league placement, or achievement award.
9. User content; social features; rankings
The App is social by design. By default, your username, profile photo or avatar, daily and historical step counts, league, achievements, and group memberships are visible to other Steppa users through global leaderboards, league standings, and group activity views.
You can opt out of public ranking at any time from Profile → Settings → Privacy (this hides your username and step counts from the public global and league leaderboards; group leaderboards remain visible to members of groups you have joined). You can also delete content you have created (e.g., groups you own) and delete your account as described in Section 17.
You are responsible for the content you submit, including usernames, group names, group descriptions, group tags, profile photos, and any invitations you send. By submitting content to Steppa, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit that content as needed to operate the App (for example, to show your username and steps in leaderboards visible to other Steppa users).
We may remove or modify user content, rename or reset a username, delete a group, or revoke a user's ability to create groups when we believe such content or behavior violates these Terms or applicable law. We are not obligated to monitor user content, but we may do so.
10. Third-party services
The App relies on or integrates with third parties, including:
- Apple (App Store, HealthKit, In-App Purchase, push notification delivery);
- Google LLC / Firebase (Authentication, Cloud Firestore, Cloud Storage, Cloud Functions, Firebase Analytics);
- Superwall (paywall presentation and subscription-status reporting);
- Sentry (error and crash reporting, in production builds).
Their terms and privacy policies apply to their services. Information about what we send to each, and why, is in our Privacy Policy.
11. Intellectual property
The App, its name, branding, and content (excluding user content you supply, such as your username, profile photo, group names, and group descriptions) are owned by us or our licensors and protected by intellectual property laws. Feedback you give us about the App may be used by us without restriction or compensation.
12. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT LEADERBOARD STANDINGS, LEAGUE PROMOTIONS, OR ACHIEVEMENT UNLOCKS WILL BE ACCURATE OR TIMELY.
Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply only to the extent permitted.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR THESE TERMS.
- OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US DIRECTLY FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM (EXCLUDING AMOUNTS PAID TO APPLE FOR IN-APP PURCHASES) OR (B) USD $50.
These limits apply even if the remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.
14. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless SMRLND LLC and its officers, directors, employees, and contractors from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the App, your violation of these Terms, or content you submit through the App.
15. Apple-specific terms
If you obtained the App from the Apple App Store, you acknowledge that:
- Apple is not a party to these Terms (except as necessary for In-App Purchase as Apple's own terms provide).
- Apple is not responsible for the App or its content, maintenance, or support.
- Apple has no obligation to furnish maintenance or support for the App.
- In the event of a failure to conform to a valid warranty (if any), you may notify Apple; to the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple and its subsidiaries are third-party beneficiaries of these Terms as relates to your license of the App from the App Store, and Apple may enforce these Terms against you.
Your right to use the App is also subject to the App Store Terms of Service and Apple Media Services terms as updated from time to time.
16. Changes to the App or Terms
We may modify, suspend, or discontinue the App or any feature, including changing which features are part of Steppa Pro versus the free tier. We may update these Terms by posting a new version with an updated "Last updated" date. Material changes about subscriptions will be communicated as required by law or App Store guidelines. Continued use after changes become effective constitutes acceptance, where permitted by law. If you do not agree, stop using the App and cancel subscriptions as described in Section 5.
17. Termination; account deletion
We may terminate or restrict your license to use the App if you violate these Terms.
You may stop using the App at any time. You may also delete your account at any time from Profile → Settings → Advanced → Delete Account. Account deletion removes your account, profile, username reservation, step history, achievements, and group memberships from our systems. Groups you created and own may be transferred or deleted depending on remaining membership.
Account deletion does not cancel an active Steppa Pro subscription, because subscriptions are billed by Apple and tied to your Apple ID rather than to your Steppa account. To cancel a subscription, follow the steps in Section 5.4 before deleting your account.
Sections that by nature should survive (including licenses granted by you, disclaimers, limitations of liability, indemnity, and governing law) survive termination.
18. Governing law; disputes
These Terms are governed by the laws of the State of Delaware, United States, excluding conflict-of-law rules, unless mandatory consumer laws in your place of residence say otherwise.
For disputes, any disputes arising out of or related to these Terms will be resolved exclusively in the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
Consumers in some regions may have non-waivable rights to use local courts or mandatory legal remedies.
19. Miscellaneous
Severability. If a provision is invalid, the remainder remains in effect.
No waiver. Failure to enforce a provision is not a waiver.
Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or asset sale.
Entire agreement. These Terms and the Privacy Policy (as applicable) are the entire agreement between you and us about the App.
Language. If we provide translations, the English version controls in case of conflict, to the extent permitted.
